总则:
工业设计意味着形状的创造,,en,组态,,en,或线条或颜色的组成,,en,或线条和颜色,,en,或者它们的三维或二维形式的组合，其给人以美感并且可以以三维或二维图案实现并用于生产产品,,en,商品或工业商品和便利的工艺品,,en,受保护的工业品外观设计,,en,工业设计权应授予新的工业设计,,en,如果在申报日期工业品外观设计与之前的任何披露不同，则工业品外观设计应视为新的,,en,先前的披露在段落中提到,,en,应该是之前的,,en,申请日期,,en,优先日期,,en,如果申请是以优先权提交的,,en, configuration, or the composition of lines or colours, or lines and colours, or the combination thereof in a three or two dimensional form which gives aesthetic impression and can be realized in a three or two dimensional pattern and used to produce a product, goods or an industrial commodity and a handy craft.

Industrial Designs that are Granted Protection
The Right to Industrial Design shall be granted for an Industrial Design that is new.
An Industrial Design shall be deemed new if on the Filing Date such Industrial Design is not the same as any previous disclosures.

The previous disclosure as referred to in paragraph (2) shall be one which before:
一. the Filing Date; 或
b. the priority date, if the Application is filed with Priority Right

Industrial Designs that are not Protected
The Right to Industrial Design shall not be granted if an Industrial Design is contrary to the prevailing laws and regulation, public order, religion, or morality.

刑法规定;

• Any person who deliberately and without rights commits any acts as referred to in Article 9 shall be shall be sentenced to imprisonment of at most 4 (四) years and/or a fine of at most Rp300,000,000.00 (three hundred million rupiahs).
• Any person who deliberately commits any acts as referred to in Article 8, Article 23 or Article 32 应判处监禁最多 1 (一) year and/or a fine of at most Rp45,000,000.00 (forty five million rupiahs).
